The "interpret that as you will" addition to previous posts means that I am able to interpret the theme's direction however loosely I please, seeing as I chose it. As I interpret it, the people in the beginning of the video were being interviewed.
The point of the common theme is to give me, Sean, and voters something on which to begin. It is not meant to knock a video from contention (unless completely and utterly irrelevant).
Anyway, this is just for future videos. The reason we created the show was to vote for better comedy, not technicalities (again, unless absurdly straying).

Who decides if the element is present? The voters, not Ryan with some post hoc explanation.

I do not disagree about the rule of theme constraint. I am stressing that there was always freedom of interpretation.
